DMCA & Copyright Infringement Policy

Last updated: August 14, 2025

Eggrate.org respects the intellectual property rights of others and expects site users to do the same. This page outlines our policy regarding copyright infringement claims, how to submit a takedown notice under the Digital Millennium Copyright Act (DMCA) or similar local laws, and the procedure for submitting a counter-notice if you believe content was removed in error.

Scope and purpose

This policy applies to claims of copyright infringement for content on Eggrate.org, including text, images, data tables, charts, or other materials that may be posted on our site. The policy is intended to provide a clear, effective process for reporting alleged violations and for resolving disputes in a lawful manner. We follow applicable international, national, and local copyright laws and will respond to valid notices in accordance with those laws.

What we consider infringing content

We consider content infringing when it reproduces, distributes, displays, or otherwise uses copyrighted works without permission from the rights holder, or without a valid legal exception (such as fair use where applicable). Examples include:

  • Copying a substantial part of another website’s original textual content or market reports;
  • Posting images or photos that you do not own or have not licensed;
  • Re-publishing proprietary databases or premium reports without authorization;
  • Using trademarks or copyrighted logos in a misleading or infringing manner.

How to submit a DMCA takedown notice

If you are a copyright owner or an authorized agent and believe that content on Eggrate.org infringes your copyright, please send a written notice containing the following information to our designated copyright agent. To expedite processing, include as many of the requested elements as possible:

  1. Your contact information: full name, mailing address, telephone number, and email address where you can be reached.
  2. Identification of the copyrighted work: a clear description of the copyrighted work you claim is infringed (for example, a specific article, image, dataset, or report). If your work has been registered, include registration details if available.
  3. Identification of the infringing material: provide the exact URL(s) on Eggrate.org where the infringing material appears. Please include the full link(s) to the page(s).
  4. Statement of good faith: a statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Statement under penalty of perjury: a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
  6. Signature: a physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.

How we respond to takedown notices

Upon receipt of a complete and valid takedown notice, Eggrate.org will take prompt action to investigate the claim. Our typical process is:

  1. Verify the notice contains required information and appears to be bona fide.
  2. Remove or disable access to the allegedly infringing content while the matter is investigated, if appropriate.
  3. Notify the account holder or content contributor that their material has been removed and provide information on how to submit a counter-notice.
  4. If a counter-notice is received and deemed valid, we may restore the content unless the complainant files a lawsuit within the time period required by law.

We will keep records of DMCA notices and responses and may share limited information with relevant parties if necessary to resolve disputes.

Counter-notice procedure

If your content was removed due to a takedown notice and you believe that the removal was mistaken or that you have the right to use the content (for example, because you are the copyright owner, you have a license, or the use is allowed by law), you may send a counter-notice containing the following:

  1. Your contact information (name, address, phone, email).
  2. Identification of the material that was removed and the URL(s) where it appeared on Eggrate.org.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed as a result of a mistake or misidentification of the material to be removed.
  4. Consent to the jurisdiction of the federal court in the jurisdiction where you reside (or another appropriate court), and a statement that you will accept service of process from the person who submitted the original takedown notice.
  5. Your willing signature (electronic or physical).

Send counter-notices to: support@eggrate.org with subject line DMCA Counter-Notice — Eggrate.org. We will follow applicable law and notify the claimant before restoring content where required.

Repeat infringer policy

Eggrate.org has a policy of terminating, in appropriate circumstances, accounts of users who are repeat infringers. We will take reasonable steps to investigate repeated complaints against an account and may limit or terminate access as necessary to prevent further infringement.

Good faith and misuse

Filing a false DMCA notice (one that knowingly misrepresents that material is infringing) may expose the filer to legal liability for damages, costs, and attorney fees under applicable laws. We encourage parties to use this process in good faith and to seek legal advice if uncertain.

Preserving evidence

If you believe someone is infringing your copyright, preserve as much evidence as possible: screenshots, copies of the original work, dates of publication, and any communications. These items help us assess the claim and, if necessary, provide documentation for legal processes.

If you are submitting a notice from outside the U.S., please include information about the legal basis for your claim under local law when possible.

Our role is to implement a fair procedure that respects both copyright owners’ rights and users’ freedom of expression where lawful.
